1. Acceptance of Terms

By creating an account and using DigiProdify, the Service, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

DigiProdify is an independent AI-powered platform that helps marketplace sellers prepare digital product drafts. The Service uses third-party AI technologies to assist with product planning, image generation, listing draft copy, and optional promotional video generation, then packages files for download and user review.

The Service is provided as is. We do not guarantee that generated content will be suitable for any specific marketplace, meet any specific quality standard, be free from errors, or comply with any marketplace policy. All AI-generated outputs are provided for user review, and the user is responsible for final editing, review, and compliance before publishing.

2a. Independence and Third-Party Technologies

DigiProdify is an independent AI-powered digital product generation platform. DigiProdify uses third-party AI technologies, including Google Gemini, Nano Banana, and Google Veo, to assist with product planning, image generation, and video generation. DigiProdify is not affiliated with, endorsed by, certified by, or sponsored by Google, Gemini, Nano Banana, Google Veo, Etsy, OpenAI, or any other third-party AI provider or marketplace mentioned on this website. All generated outputs are provided for user review. Users are responsible for reviewing, editing, and ensuring that their final products comply with marketplace rules, copyright requirements, and applicable laws before publishing.

3. Account Registration

You must provide a valid email address and a password of at least 8 characters to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must be at least 18 years old to use the Service. By registering, you represent that you meet this requirement.

4. Credits and Subscriptions

The Service operates on a credit system. Credits are consumed when you generate images or premium videos. The number of credits consumed per operation is shown before generation begins.

Planning: 1 credit per planning attempt
Image generation: 1 credits per image
Cover generation: 1 credit per cover
Validation: 1 credit per completed generation
Premium video generation: metered by duration and resolution before generation

Credits are granted monthly as part of a subscription plan. Unused credits do not roll over to the next billing period. Subscription fees are non-refundable except as described in our Refund Policy.

5. Intellectual Property

You retain ownership of the product ideas and prompts you submit. The generated output files (images, PDFs, videos, copy) are provided to you for your personal and commercial use, including sale on Etsy and other marketplaces.

Generated outputs may include AI-generated material. You are responsible for reviewing final files, confirming your right to use prompts and inputs, and keeping marketplace listing descriptions accurate. The default AI disclosure is: “This digital product was created with AI-assisted design tools and reviewed by the seller.”

You may not use the Service to generate content that infringes on third-party intellectual property rights, including copyrighted characters, trademarked names, or protected artwork styles.

We retain the right to use anonymized, aggregated data about product generation for improving the Service.

6. Prohibited Uses

You may not use the Service to generate, request, upload, store, or distribute any of the following content. These restrictions apply to prompts, inputs, generated outputs, and any derivative files. Violations may result in immediate account termination and may be reported to law enforcement where required by law. Adult and sexual content (strictly prohibited):

NSFW (not safe for work) content of any kind
Sexually explicit content
Pornographic content
Adult content intended for sexual gratification
Nudity or sexualized nudity, whether photorealistic, illustrated, or stylized
Erotic or fetish content
Any sexual content involving minors (CSAM) — this is strictly forbidden and will be reported to authorities
Non-consensual sexual content, including content depicting real or implied victims
Deepfake sexual content or any sexualized depiction of a real, identifiable person without their explicit, verifiable consent
AI-generated adult content of any form, even when stylized as art, anime, or fantasy

Other prohibited uses:

Generate content that is illegal, harmful, hateful, harassing, threatening, or misleading
Generate content that promotes violence, self-harm, or terrorism
Infringe on any third-party intellectual property rights
Generate marketplace listings using brands, celebrities, characters, or artwork styles you do not have rights to use
Represent generated drafts as official, certified, approved, or guaranteed by Etsy or any other marketplace
Attempt to reverse-engineer, scrape, or abuse the AI generation pipeline
Attempt to bypass, disable, or evade content moderation, safety filters, or usage limits
Share, resell, or sublicense access to the Service
Create accounts for automated or bulk generation without our written consent

7. Termination

We reserve the right to suspend or terminate your account at any time if we determine that you have violated these Terms. Upon termination, your access to the Service and generated files will be revoked.

You may close your account at any time by contacting support. Closing your account does not entitle you to a refund of unused subscription time or credits.

8. Limitation of Liability

To the maximum extent permitted by law, DigiProdify shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to lost profits, data loss, or marketplace rejection of generated products.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the 3 months preceding the claim.

9. Changes to Terms

We may update these Terms at any time. We will notify you by email or by displaying a notice in the Service. Continued use after the effective date of changes constitutes acceptance.

10. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms will be resolved through binding arbitration or in a court of competent jurisdiction.
